Third Party Claims for vehicle repairs, hire and bodily injury cost the insurance industry hundreds of millions of pounds each year. The advent of Credit Hire, Conditional Fee Agreements with success fees and After the Event Insurance policies’ has contributed heavily. This year the insurance industry can look forward to the new MOJ timescales for investigation and settlement of low value personal injury claims (below £10000). This could potentially lead to an increase in solicitor and litigation cost, unless the defendant insurer is able to work within the tight new timescales.
CAA already has a proven, pro-active, track record regarding Third Party Intervention / Vehicle Repair Management and Uninsured Loss Recovery. An experienced team, adopting a claims license structure, ensures the same commitment and quality of handling is also employed on their Third Party Property and Personal Injury claims allowing them to handle cases up to £75000 with the experience available to deal with claims up to £250000.
Adopting their pro-active approach, CAA initially endeavours to intervene and capture any injured TP claimant and offer rehabilitation or the arrangement of an independent medical examination. If the client so instructs however, they will put forward a pre-medical examination offer in an attempt to settle the claim as quickly as possible.
Any claimant can seek legal advice during the course of their claim. In an attempt to avoid the involvement and subsequent additional cost of claimant solicitors though, CAA will initiate early, and maintain regular communication with the Third Party to ensure they feel their claim is being dealt with fairly and effectively. Should the claimant seek legal representation however, CAA will still closely manage the claim, maintaining control, rather than letting the Third Party solicitors dictate proceedings.
CAA has thorough low velocity impact and fraud checks to highlight any suspect cases as early as possible. Initial reports to clients will allow them to decide if they wish to seek an early economic settlement or allow the case to run to litigation to be defended by one of our experienced panel solicitors.
